Terms and Conditions for Using the Service Provided by the Doosan Art Center of the Doosan Yonkang Foundation
- 1. These Terms and Conditions seek to set forth basic matters concerning the conditions for the use of the service (“Service”) provided by the Doosan Art Center (“Center”)
- 2. When a user clicks the “registration” button at the Center’s homepage (www.doosanartcenter.com), which is part of the procedure for using the Service, such shall be deemed a provision of consent to these Terms and Conditions. Matters such as rights, obligations, and responsibilities of the respective Parties other than those stipulated in these Terms and Conditions shall follow generally accepted commercial practices in South Korea and relevant laws including the Telecommunications Business Act.
"User" in these Terms and Conditions shall mean a party receiving the Service under these Terms and Conditions as a member of the Center. A user shall use his/her real name at all times when using the Service.
Article 3 (Membership Subscription)- 1. A person who wishes to use the Service shall apply for membership by entering his/her personal information as required by the procedure and then clicking the "registration” button as stated in Clause 2, Article 1 (Purpose). The Center shall reject the application for the Service in any of the following cases:
- 1) One whose status as member is revoked as per Clause 3, Article 6 (User’s Withdrawal of Membership or Revocation of Membership) of these Terms and Conditions; note, however, that the foregoing shall not apply to a person who has obtained the Center’s approval for new membership application after 3 years have passed following the revocation of his/her status as member
- 2) Provision of false or wrong information or failure to provide the necessary information during registration
- 3) A person’s registration is judged likely to cause a conspicuous technological problem to the Center.
- 2. The Center’s approval of membership application shall be deemed to take effect the moment the approval has reached the applicant.
- 3. When there has been a change in the information on a member as provided to the Center pursuant to Clause 1, Article 2 (Definition of User), the member shall immediately inform the Center accordingly.
- 1. The Center shall provide the following Service to users:
- 1) Performance reservation
- 2) Service related to the bulletin board and material office
- 3) Service to be provided to users through the Center’s in-house development and contract signed with other businesses for cooperation
- 2. The Center may change the contents of the Service and the date of Service commencement. In such case, the Center shall inform users of said change as per Clause 2, Article 7 (Provision of Information to Users).
- 1. In case of repair of an information/communication facility including computer or stoppage of the relevant service, the Center may stop providing the Service temporarily or substitute such with a new Service. In connection with the foregoing, the Center may stop the Service permanently if necessary under the prevailing situation.
- 2. In case of temporary or permanent stoppage of the Service as stated above, the Center shall inform the users accordingly as per Clause 2, Article 7 (Provision of Information to Users). The foregoing shall not apply when the situation prevents the Center from providing such information to users in advance for reasons beyond the Center’s control (such as disk failure or system failure caused by reasons other than the system manager’s willful misconduct or egregious error).
- 3. The Center shall not be responsible for a problem in the Service caused by reasons due to force majeure including acts of God or reasons attributable to a third party.
- 1. A user may ask the Center for the withdrawal of his/her registration as member at any time. In such a case, the Center shall process such request immediately.
- 2. The Center may stop or terminate a user’s membership in an appropriate method at its discretion in any of the following cases:
- 1) Provision of false information at the time of registration
- 2) A member engaging in an act intended to obstruct others’ use of the Service or threatening to disrupt the order of transaction, e.g., through the dishonest use of personal information of others
- 3) Attempt to use the Service for any act prohibited by the relevant law or these Terms and Conditions or engage in an act designed to disrupt the country’s social order or long-established customs
- 4) Failure to meet the conditions stipulated by the Center
- 3. In case of withdrawal of membership, the Center shall inform the member concerned accordingly in advance but shall give him/her an opportunity to explain his/her situation.
- 1. Concerning a notice to a specified user, the Center may send such to the mailing address provided to it.
- 2. As for a notice to unspecified multitudes, such may be replaced by the posting by the Center of a notice on its online bulletin board for more than a week.
- 1. The Center shall do its best to protect users’ personal information registered with it under the relevant law.
- 2. The Center shall not disclose to a third party a member’s personal information that it has learned in association with the Service without the member’s prior consent, unless required to do so under the law.
- 3. The Center may tabulate statistics using members’ personal information either in part or in whole within the extent permitted by law.
- 4. The Center is under no obligation to protect the user’s personal information if the Service is used in the Doosan website, affiliate site, or other additional contents or if the user posts his/her personal information.
- 1. The Center shall not engage in any act prohibited by law or these Terms and Conditions or designed to disrupt the country’s social order or long-established customs. The Center shall do its best to provide stable Service under these Terms and Conditions.
- 2. The Center shall establish a security system designed to protect users’ personal information so that users can use the Service safely.
- 3. The Center shall not send users unwanted e-mails designed for advertising.
- 4. The Center shall compensate for any loss or damage incurred by users due to the Center’s willful misconduct or egregious error.
- 1. Basically, the responsibility for managing a user’s ID and password shall lie with the user, except in cases wherein the Center assumes responsibility under the law.
- 2. A user shall not let a third party use his/her ID or password.
- 3. Upon discovering that his/her ID or password has been stolen or is being used by a third party, the user shall inform the Center immediately and follow the Center’s instruction.
- 1. Users shall not engage in the following acts:
- 1) Provision of false personal information when applying for the Service or when changing the personal information previously registered with the Center
- 2) Changing information put up at the Center
- 3) Act that infringes on moral rights or intellectual property rights or disrupts the business of the Center or a third party
- 4) Dishonest use of another member’s ID
- 5) Sending junk mail, spam mail, chain letter, or mail asking others to engage in illegal pyramid sales or message of obscene or offensive nature or putting up information that run counter to the country’s long-established customs
- 6) Transmitting or putting up information prohibited under the law, including computer program
- 7) Putting up an article or sending mail by pretending to be an employee of the Center or the Service Manager or another person
- 8) Putting up or dispatching via e-mail software virus or material that includes computer code, file, or program designed to disrupt the normal operation of computer software/hardware or telecom equipment
- 9) Stalking or harassing other users
- 10) Collecting, storing, or disclosing the personal information of other users without their prior consent
- 11) Engaging in a commercial activity using the Service, such as putting up ads or disseminating propaganda or dispatching spam mails targeting unspecified multitudes
- 12) Violation of the terms and conditions or other regulations associated with the Service
- 2. Concerning a user engaging in any of the aforesaid acts, the Center may stop or revoke his/her membership as per Clauses 2 and 3, Article 6.
- 3. In case of loss or damage incurred by the Center or another user due to reasons attributable to a user, the user concerned shall compensate for such loss or damage.
In any of the following cases concerning a material put up by a user on a bulletin board, the Center may delete the material without serving prior notice to the user and stop or terminate his/her membership:
- 1) Containing information intended to slander or tarnish the honor of another user or a third party
- 2) Containing information that runs counter to the country’s long-established customs
- 3) Contents associated with a crime
- 4) Contents infringing on a third party’s rights, including intellectual property rights
- 5) Contents violating the law
- 1. All intellectual property rights concerning literary works created by the Center shall rest with the Center.
- 2. Users shall neither use the information they obtained through the Service for commercial purposes nor let a third party use it through reproduction, transmission, publication, distribution, etc., without the Center’s prior consent.
- 1. The Center reserves the right to amend these Terms and Conditions provided the Regulation of Standardized Contracts Act, the Framework Act on Electronic Commerce, the Digital Signature Act, and the Act on the Promotion of Information and Communications Network Utilization and Information Protection, etc., are not violated.
- 2. In case of amendment to these Terms and Conditions, the Center shall put up -- on the initial screen of the homepage beginning 7 days until one day prior to the amendment -- a notice concerning the amendment together with the existing Terms and Conditions and date of and reasons for amendment.
- 3. Any amendment to these Terms and Conditions shall also apply to existing members provided the amendment does not violate any law.
- 4. A user having objection to the amendment to these Terms and Conditions may withdraw his/her membership as per Clause 1, Article 6 (User’s Withdrawal of Membership or Revocation of Membership).
Any lawsuit regarding a dispute occurring between the Center and a user concerning the Service shall be filed at the court in the country having competent jurisdiction pursuant to the Civil Procedure Act.
These Terms and Conditions shall be implemented on March 10, 2010.
Additional Rules
The Center values customers’ personal information and complies with the Act on the Promotion of Information and Communications Network Utilization and Information Protection, etc. The Center lets customers know how their personal information is used through the Personal Information Handling Guidelines and what measures it takes to protect their personal information. In case of revision of said guidelines, the Center shall provide the relevant information through the website bulletin board or by individual notice.

The Center collects the following personal information for Service application and relevant counseling:
- Customers’ names, login IDs, passwords, home phone numbers/addresses, cell phone numbers, e-mail addresses, resident registration numbers, connections log, connection IP information, whether customers agree to receive newsletters
- How to collect personal information: at the time of subscription to membership or mailing service or submission of application for use of building space, issuance of pass for a facility, registration at Art School
- At the time of membership subscription through the homepage or submittal of written application via fax
The Center uses the personal information it collects for the following purposes:
- In contracts
- - Demographic analysis (based on users’ age, gender, region)
- - Collecting information on members’ use of the Service and having it reflected on the Service-related policy (Service reshuffling or expansion)
- - Provision of information on new service, performance/lectures, or events
- * As a rule, we do not use the information provided by a member at the time of member subscription for purposes other than that disclosed to the member.
- * The valid period of membership shall be from the signing of the use contract to a user’s voluntary withdrawal or the Center’s decision on withdrawal.
- Membership management
- - Identification of a member concerning the use of the Service; prevention of dishonest use of membership; confirmation of willingness to subscribe; checking the legal guardian’s consent to the Center’s collection of personal information for children under 14 years; handling of complaints; provision of notices
- Use in marketing and ads
Provision of ad-like information; provision of the Service based on demographic features
The Center ensures that the relevant information is destroyed once the purpose of collection and use of personal information is accomplished.
<Reasons for retaining personal information under the internal guidelines>- For members’ IDs
- - Reason for retention: To prevent confusion in the provision of the Service
- - Retention period: 1 year
As a rule, the Center retains members’ personal information for a given period of time under the law. In this case, the Center shall use it only for the stipulated purpose.
- For transaction-related records
- - Reason for retention: To comply with the Act on Consumer Protection in Electronic Commerce Transactions, etc.
- - Retention period: 5 years
The Center does not provide users’ personal information to a third party except on the following occasions:
- - When the user has given his/her consent in advance
- - When required by law; when there is a request from the investigation agency under the law
The Center provides users’ personal information for the following purposes:
- Purpose of provision of personal information: affiliated marketing
- - Provided to: affiliated businesses
- - Information provided: users’ names, e-mail addresses, cell phone numbers, addresses, and DOBs
- - Period for retaining and using personal information: until the termination of the affiliation contract
- - When the user has given his/her consent in advance
- - When required by law; when there is a request from an investigation agency under the law
A member’s personal information provided at the time of the following applications will be deleted permanently from the Center’s database upon the member’s withdrawal of his/her membership: applying for a pass needed to enter the Center’s facilities; attending Art School; using a building space.
■ Provision of personal information to a third partyThe Center does not provide users’ personal information to a third party except on the following occasions:
- - When the user has given his/her consent in advance
- - When required by law; when there is a request from an investigation agency under the law
The Center operates the procedure for users’ personal information as follows:

- Contents of entrustment: homepage maintenance (contents management) and web programming management
- Entrusted to: C’ Square Soft
- Contents of entrustment: membership management; identification of members concerning their use of the Service; provision of ad-like information; website and system management; reservation for performances; member information management
A user may ask the Center to allow him/her to access his/her personal information registered with the Center and revise it or withdraw his/her membership. For inquiries, please contact the Center’s personal information management manager (webmaster) in writing or by phone or via e-mail. Concerning personal information whose cancellation or deletion has been requested by a user, the Center shall handle such in accordance with its internal regulation on the period for retaining and using users’ personal information.
■ Matters concerning the installation and operation of devices for the automatic collection of personal informationThe Center does not operate a device for the automatic collection of personal information created in the course of using Internet service, including cookies.
■ Users’ complaints regarding the Center’s handling of personal informationThe Center operates a department and has employees in charge as follows in connection with the need to handle users’ complaints regarding the way user’s personal information is handled and to protect their personal information:

- 6) Transmitting or putting up information prohibited under the law, including computer program
- 7) Putting up an article or sending mail by pretending to be an employee of the Center or the Service Manager or another person
- 8) Putting up or dispatching via e-mail software virus or material that includes computer code, file, or program designed to disrupt the normal operation of computer software/hardware or telecom equipment
- 9) Stalking or harassing other users
- 10) Collecting, storing, or disclosing the personal information of other users without their prior consent
- 11) Engaging in a commercial activity using the Service, such as putting up ads or disseminating propaganda or dispatching spam mails targeting unspecified multitudes
- 12) Violation of the terms and conditions or other regulations associated with the Service
- 2. Concerning a user engaging in any of the aforesaid acts, the Center may stop or revoke his/her membership as per Clauses 2 and 3, Article 6.
- 3. In case of loss or damage incurred by the Center or another user due to reasons attributable to a user, the user concerned shall compensate for such loss or damage.
In any of the following cases concerning a material put up by a user on a bulletin board, the Center may delete the material without serving prior notice to the user and stop or terminate his/her membership:

The Center collects the following personal information for Service application and relevant counseling:
- Customers’ names, login IDs, passwords, home phone numbers/addresses, cell phone numbers, e-mail addresses, resident registration numbers, connections log, connection IP information, whether customers agree to receive newsletters
- How to collect personal information: at the time of subscription to membership or mailing service or submission of application for use of building space, issuance of pass for a facility, registration at Art School
- At the time of membership subscription through the homepage or submittal of written application via fax
The Center uses the personal information it collects for the following purposes:
- In contracts
- - Demographic analysis (based on users’ age, gender, region)
- - Collecting information on members’ use of the Service and having it reflected on the Service-related policy (Service reshuffling or expansion)
- - Provision of information on new service, performance/lectures, or events
- * As a rule, we do not use the information provided by a member at the time of member subscription for purposes other than that disclosed to the member.
- * The valid period of membership shall be from the signing of the use contract to a user’s voluntary withdrawal or the Center’s decision on withdrawal.

The Center ensures that the relevant information is destroyed once the purpose of collection and use of personal information is accomplished.
<Reasons for retaining personal information under the internal guidelines>- For members’ IDs

As a rule, the Center retains members’ personal information for a given period of time under the law. In this case, the Center shall use it only for the stipulated purpose.
- For transaction-related records

The Center does not provide users’ personal information to a third party except on the following occasions:

A member’s personal information provided at the time of the following applications will be deleted permanently from the Center’s database upon the member’s withdrawal of his/her membership: applying for a pass needed to enter the Center’s facilities; attending Art School; using a building space.

A user may ask the Center to allow him/her to access his/her personal information registered with the Center and revise it or withdraw his/her membership. For inquiries, please contact the Center’s personal information management manager (webmaster) in writing or by phone or via e-mail. Concerning personal information whose cancellation or deletion has been requested by a user, the Center shall handle such in accordance with its internal regulation on the period for retaining and using users’ personal information.
■ Matters concerning the installation and operation of devices for the automatic collection of personal informationThe Center does not operate a device for the automatic collection of personal information created in the course of using Internet service, including cookies.
